In consideration of my participating and/or attending in the 2024 Festival on the Brazos Weekend and/or its pre-production and/or post-production functions, rehearsals, activities, socials, and events of whatsoever kind and nature, and wherever the same may be held, (Thursday through Sunday) I hereby expressly waive, release and discharge for myself, my heirs, and our executors, administrators, legal representatives, assigns and successors in interest (hereinafter collectively referred to as “my successors”), any and all rights, claims and causes of action which I have or which may hereafter accrue to me and/or my successors against FESTIVAL ON THE BRAZOS, its officers, directors, patrons, members, sponsors, promoters and any promoting organization(s), property owners and all public and private entities and their successors (hereinafter referred to collectively as “Festival on the Brazos Weekend”) through or by which the Festival on the Brazos, and its related or associated events, activities and functions will be held, against all claims for damages for personal injury to me and for any damages to or loss of any property arising out of or attributed directly or indirectly to the operations, acts or omissions of Festival on the Brazos.
I AGREE AND BIND MYSELF AND MY SUCCESSORS TO THE REPRESENTATIONS AND STATEMENTS CONTAINED IN THIS AGREEMENT, WHICH ARE CONTRACTUAL AND ARE NOT MERE RECITALS. SHOULD I OR ANY OF MY SUCCESSORS ASSERT ANY CLAIM OR CAUSE OF ACTION AGAINST FESTIVAL ON THE BRAZOS FOR PERSONAL INJURY AND/OR PROPERTY DAMAGE, I AND/OR MY SUCCESSORS SHALL INDEMNIFY AND HOLD HARMLESS FESTIVAL ON THE BRAZOS FOR ALL EXPENSES (INCLUDING LEGAL FEES), COSTS AND DAMAGES INCURRED IN INVESTIGATING, LITIGATING, DEFENDING, SETTLING AND/OR DISCHARGING SUCH CLAIM(S) OR CAUSE(S) OF ACTION EVEN IF SUCH CLAIM(S) OR CAUSE(S) OR ACTON IS/ARE CAUSED, IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY BY ME AND/OR BY NEGLIGENCE OF FESTIVAL ON THE BRAZOS.
This Agreement may not be modified orally or by the striking or deletion or addition to any part of this Agreement. Any waiver by FESTIVAL ON THE BRAZOS of any provision of this Agreement shall not be construed as a modification of any other provision herein nor as consent to any subsequent waiver or modification.
